The framework addresses distance selling to Belgian private individuals directly, and attaches a representative requirement to it.

Only the product box is counted

The parcel, filler, tape and any inner packaging are all packaging, and the parcel to a consumer is household packaging.

Volumes cross a threshold unnoticed

The obligation to join a scheme starts at a defined annual weight. Growth during a year can cross it without anyone noticing.

Frequently asked

We only ship a few hundred parcels a year. Does this apply?

Possibly not for scheme membership, which starts at a defined annual packaging weight. The information obligation and the representative question are assessed separately.

Is the parcel itself packaging?

Yes, and for a distance sale to a private individual it is treated as household packaging rather than industrial transport packaging.

Do we need a Belgian company?

No. You need a representative established in Belgium, appointed by written mandate. That is not the same as incorporating.
